THE PROBLEM

Staying Compliant When Sourcing Global Talent

BET Software has its roots in South Africa, where they’re focused on building innovative gaming software to meet increasing demand worldwide. However, the local talent pool of developers has become too saturated to keep up with the team’s demand for new talent.

With ambitious goals to expand their global footprint, the team faced a twofold challenge as they set about scaling their international team:

  • The gaming software industry faces strict regulations, with compliance requirements differing across countries. This requires a solid grasp of local labor laws, tax regulations, and compliance standards in each new market. Non-compliance could lead to fines, legal issues, and reputational damage, making it crucial to partner with experts in navigating these complexities.
  • This was especially challenging in Kenya, where retaining key employees while ensuring regulatory compliance was a top priority. They had four employees in Kenya who were seconded to them via Hollywoodbets, a different company within the broader organization. After Hollywoodbets closed its entity in Kenya, BET Software hoped to retain these valued employees. However, they didn’t have the time to establish a legal entity of their own in Kenya to compliantly hire them.

Alternatively, they could have transitioned their existing team members to independent contractors. This would have resulted in the loss of competitive benefits, required employees to provide their own equipment, and placed the burden of tax compliance on the contractors.

Overall, this presented too much risk to BET Software’s relationship with the workers they wanted to retain.
